Question: With food allergies and an epi pen, with unknown reactions, when do you do a 504 versus an individual health plan? Almost everyone on here seems to swear by the 504 and some say that's not enough. Im quite confused. I am a teacher and I pay attention to all health notes. I know 504 plans have legal teeth, but what exactly does that mean in terms of reality? I know the only thing we all want to do is keep our kids safe.
Questions: At what grade can you have a 504 plan / IEP? Can you only have one starting in Kindergarten? Does it matter how the school is funded? i.e. are certain 'types' of school covered by Section 504 vs. others?
Question 1: Are parents legally entitled to be at the evaluation meeting for the initial 504? Do they have a right to speak or add input beyond the documentation they provide? Question 2: If the school or school system declares your child NOT eligible for a 504, what appeals rights do you have?
My question: My child is in a secular private school. I do not know if they receive any funding from the US govt. Is is possible to get a 504 plan in this school?

He stated that a small study showed that only a rash occurred with peanut butter spread on an allergic child's skin. My child has had hives and swelling with just skin contact....Many times. Terrific webinar though I wish the small study of 30 children who showed no reaction to peanut butter being a foot from their faces would not have been included. My child has twice suffered angioedema after being in the same room as an open jar of peanut butter for only moments so this information works counter to my efforts in accommodating my child in school. I'm sorry you are feeling so stressed over starting Kinder. Have you requested a 504 evaluation?? The last link in #5 above has lots of resources on that process. That is your best way to get accommodations for your kiddo. In that type of plan is where you can specify things like handwashing after snack/lunch, a peanut free table/zone in the cafeteria, etc. Have you discussed w/ the doc what he thinks are reasonable/necessary accommodations??
I CAN'T wear a face covering. It is a seizure trigger for me. Just as there should not be a one-size-fits-all 504 plan, so too there should not be a one-size-fits-all cloth face covering plan. I am frustrated with the "recommendations" and the "guidance" I get from officials. My FAK has both food allergies and asthma, and I'm trying to get his 504 plan to allow him NOT to wear a cloth face covering. The way the governor's executive order reads, that means he has to wear a face shield instead. Wearing a cloth over his mouth and nose for 7 hours is not a good idea. A face shield should allow a teacher to see any hives or facial swelling, should they occur, should allow him better air flow, and won't attract dust mites on the cloth for concentrated breathing. My son has been skin pricked tested 4 times and the last time 3 month ago his tree nut came back negative. All other three skin prick test came back 6+ peanuts & 3+ tree nuts I was suprised when tree nuts came back negative. We still keep him away from all tree nut just to be on the safe side but what are the chances of him outgrowing just the tree nut since he was 3+ before? I have two children with close to 40 ER visits between them for allergic reactions. One has had RAST scores over 100 to Peanuts since infancy - he is 12.
